3. Data Processing

3.1 Scope and purpose of data collection, processing and use

ICO Innovative Computer GmbH is responsible for consulting, sales and implementation in the field of server, storage, industrial computer, scanning and other complex special solutions. For this purpose, we also collect personal data from customers, interested parties and suppliers. We only disclose your personal data to third parties if this is necessary to process a contract or a legal obligation or if there is a legitimate interest. For example, we transfer data to companies entrusted with the delivery of the goods, to Creditreform to check the creditworthiness of a commercial loan or to suppliers or manufacturers for the purpose of project registration, product registration, licensing, warranty extension or direct deliveries. Beyond this, we will not pass on any personal data to third parties without the express consent of the person concerned.

3.2 Data Deletion and Storage Duration

We adhere to the principles of data avoidance and data economy. The duration of the data storage depends on the statutory storage obligations and usually amounts to 10 years, unless a necessity exists for the further storage of the data for a conclusion of a contract or a fulfilment of a contract.

3.3 Use of Your Data for Advertising Purposes

In addition to processing your data to complete your purchase at ICO Innovative Computer GmbH, we also use your data to communicate with you about your orders, certain products or marketing campaigns and to recommend products or services that may be of interest to you. You can object to the use of your personal data for advertising purposes at any time, either as a whole or for individual purposes, without incurring any costs other than the transmission costs according to the basic tariffs. A written message (e.g. email, fax, letter) sent to us using the contact data specified under point 1 is sufficient.

3.3.1 Newsletter

For the dispatch of the newsletter we use the so-called double opt-in procedure, i.e. we will only send you a newsletter by email if you have expressly confirmed to us beforehand that we should activate the newsletter service. We will then send you a notification email and ask you to confirm that you wish to receive our newsletter by clicking on a link contained in this email. Should you no longer wish to receive newsletters from us at a later date, you can object to this at any time without incurring any costs other than the transmission costs according to the basic tariffs. A written message (e.g. email, fax, letter) sent to us using the contact data specified under point 1 is sufficient. Of course, you will also find an “unsubscribe” link in every newsletter.

3.4 Legal Basis

If we have the consent of the data subject to the processing of their personal data for one or more specific purposes, Section 6(1) of the GDPR serves as the legal basis. This is also the case for the processing of data for the performance of a contract to the extent necessary or the fulfilment of a legal obligation to which the controller is subject. If the processing is necessary to safeguard the legitimate interests of our company or a third party, unless the interests or fundamental rights and freedoms prevail, Section 6(1) of the GDPR serves as the legal basis.

4. Data Protection Rights of the Data Subjects

ICO Innovative Computer GmbH takes appropriate measures to provide the data subject with all information necessary for the exercise of their rights in a transparent, comprehensible and easily accessible form and in plain language.

The information is transmitted in writing or in another form, if necessary also electronically. If requested by the data subject, the information may be provided orally, on condition that the identity of the data subject has been established in another form.

We are obliged to guarantee you transparent information, means of communication and modalities for the exercise of your rights.

The data subject has the right to demand that the data controller immediately rectify any inaccurate personal data concerning him or her. Taking into account the purposes of the processing, the data subject has the right to request the completion of incomplete personal data, including by supplementary declaration.

Objection to the processing of your data by us and data transferability if you have consented to data processing or have concluded a contract with us: If you have given us your consent, you can revoke it at any time with future effect.

4.1. Right to Deletion

The data subject has the right to demand that the controller delete personal data relating to him or her without delay, and the controller is obliged to delete personal data without delay if any of the following applies:

  • 1. Personal data is no longer necessary for the purposes for which they were collected or otherwise processed.
  • 2. The data subject revokes the consent on which the processing was based pursuant to Section 6(1)(a) or Section 9(2)(a) and there is no other legal basis for the processing.
  • 3. The data subject objects to the processing pursuant to Section 21(1) and there are no overriding legitimate reasons for the processing, or the data subject objects to the processing pursuant to Section 21(2).
  • 4. The personal data were unlawfully processed.
  • 5. The deletion of the personal data is necessary to fulfil a legal obligation under Union law or the law of the member state to which the controller is subject.
  • 6. The personal data were collected in relation to information society services offered in accordance with section 8(1).

4.2. Right to Limitation of Processing

The data subject has the right to demand that the controller restrict the processing if:

  • 1. the correctness is disputed
  • 2. the processing is unlawful
  • 3. the controller no longer requires the personal data for the purposes of processing
  • 4. the data subject has lodged a statement of opposition to the processing operation in accordance with Section 21(1).

5. Encryption

In order to protect the security of your data during transmission, we use state-of-the-art encryption procedures (e.g. SSL) via HTTPS.

6. Contact Form

If you contact us by email or contact form with questions of any kind, you give us your voluntary consent for the purpose of the establishment of contact in response to an inquiry. For this purpose, it is mandatory to provide a valid email address. It is used to assign the request and then answer it. The provision of further data is voluntary. The information you provide will be stored for the purpose of processing your inquiry and for possible follow-up questions. Personal data will be deleted automatically after your request has been processed.

7. Live-Chat

Your use of the ICO Live Chat to assist you online in selecting the appropriate system or device is voluntary. During the chat, an ICO employee can either create and edit your order in the background or help you in case of difficulties and answer your questions directly.

8. Use of Social Plug-Ins

On our website social plug-ins of the following social networking sites are used:

  • Facebook (Facebook Inc., 1601 S. California Ave, Palo Alto, CA 94304, USA)
  • Twitter (Twitter, Inc., 1355 Market St, Suite 900, San Francisco, CA 94103, USA)

A data protection friendly so-called 2-click method is used. The plug-ins are deactivated by default. Data will not be transferred to the operators of the platforms concerned until you have activated the plug-ins with a first mouse click. Once the plug-ins have been activated, data is transferred to the operators of the platforms concerned in the way described below. However, we have no influence on the extent of the data collected by means of the plug-ins, so that the following information merely reflects our level of knowledge:

As soon as you view one of our websites provided with an activated plug-in, a connection is established to the servers of the provider of the respective plug-in. Thereby, content is loaded from the provider's servers and information is transmitted to the provider. This information includes, for example, your IP address and the page you have just visited. This happens regardless of whether you are logged in to the respective social network or not. If you are logged in to the respective network at the same time, the respective provider can identify you as a specific user because your user ID is recorded in addition to the address of the website visited, the date, time and browser-related information. Logging out of the network in question may prevent the data from being assigned to your user account. Alternatively, you can also prevent data transmission to the network by using special browser add-ons such as Facebook blockers.

If you recommend content with the help of the activated plug-ins, for example by clicking a "Like" button, the corresponding information is transmitted directly to the respective social network and stored there as well. The data collected by the provider can be used to create user profiles. 9. Embedded YouTube Videos

We embed YouTube videos in some places on our website. YouTube, LLC, 901 Cherry Ave, San Bruno, CA 94066, USA is the operator of the corresponding plug-ins. When you visit a page with the YouTube plug-in, a connection to YouTube servers is established. This will tell YouTube which pages you are visiting. If you are logged in to your YouTube account, YouTube can personally assign your surfing behaviour to you. To prevent this, you should log out of your YouTube account beforehand.

If a YouTube video is started, the provider uses cookies which collect information about the user behaviour. If you have deactivated the saving of cookies for the Google Ad program, you will not have to expect such cookies when watching YouTube videos. However, YouTube also stores non-personal usage information in other cookies. If you wish to prevent this, you must block the storage of cookies in your browser.

10. Cookies

We use cookies to make our website more user-friendly. Cookies are small text files that are transferred from a web server to your hard drive. The information contained in cookies helps us to make navigation easier for you and to display our web pages correctly. Of course, you can also view our website without cookies. Internet browsers are regularly set to accept cookies. Cookies cannot be used to start programs or transfer viruses to a computer. Under no circumstances will the data collected by us be passed on to third parties or linked to personal data without your consent.

11. Log Files

Each time the pages of ICO Innovative Computer GmbH are accessed, usage data is transmitted by the respective Internet browser and stored in log files, the so-called server log files. The stored data records contain the following data: date and time of the retrieval, name of the retrieved page, IP address, referrer URL (URL from which you came to the website), the amount of data transmitted, as well as product and version information of the browser used. The IP addresses of the users will be deleted or anonymised after the end of their use. In case of anonymisation, the IP addresses are changed in such a way that the individual details about personal or factual circumstances can no longer be allocated to a specific or identifiable natural person or can only be allocated with a disproportionately large expenditure of time, money and labour. We evaluate these log file data records in anonymous form in order to further improve our services and the ICO Shop and make them more user-friendly, to find and correct errors more quickly and to control server capacities. For example, it can be traced at which time the use of the ICO Shop is particularly popular and provide corresponding data volume to guarantee you the fastest possible shopping. In addition, an analysis of the log files enables us to identify and correct any errors in the ICO Shop more quickly.

12. GOOGLE ANALYTICS

Google Analytics is a service provided by Google Inc., 1600 Amphitheatre Parkway, Mountain View, CA 94043, USA ("Google"). This website uses Google Analytics, a web analysis service provided by Google. Google Analytics uses cookies, which are text files placed on your computer, to help the website analyse how visitors use the site. The information generated by the cookie about your use of the website will generally be transmitted to and stored by Google on servers in the United States. However, if IP anonymisation is activated on this website, your IP address will be shortened by Google in advance within member states of the European Union or in other signatory states to the Agreement on the European Economic Area. The IP address transmitted by your browser as part of Google Analytics is not combined with other data from Google. The ICO uses Google Analytics with the extension "_anonymizeIP()". This shortens the IP addresses collected by Google Analytics. This measure is intended to prevent Google from combining IP addresses with personal information. Given the discussion about the use of analysis tools with complete IP addresses, we would like to point out that this website uses Google Analytics with the extension "_anonymizeIp()" which means that IP addresses are only processed in an abbreviated form in order to exclude direct personal references.

13. GOOGLE ADWORDS CONVERSION-TRACKING

ICO Innovative Computer GmbH uses the online advertising program "Google AdWords" and conversion tracking as part of Google AdWords. The cookie for conversion tracking is set when a user clicks on an ad placed by Google. These cookies expire after 30 days and are not used for personal identification. If the user visits certain pages of the ico.de website and the cookie has not yet expired, Google and ICO Innovative Computer GmbH can recognise that the user clicked on the ad and was forwarded to this page. Each Google AdWords customer receives a different cookie. Cookies therefore cannot be tracked through the websites of AdWords customers. The information collected through the conversion cookie is used to generate conversion statistics for AdWords customers who have opted for conversion tracking. Customers will know the total number of users who clicked on their ad and were directed to a page with a conversion tracking tag. However, they will not receive information that can be used to personally identify users. Users who do not wish to participate in tracking can easily disable the Google Conversion Tracking cookie from their Internet browser under "User Preferences". These users are not included in the conversion tracking statistics.

14. Use of Matomo

On this website data is collected and stored using the web analysis service software Matomo (www.matomo.org), a service of the provider InnoCraft Ltd., 150 Willis St, 6011 Wellington, New Zealand, ("Matomo") on the basis of our legitimate interest in statistical analysis of user behaviour for optimisation and marketing purposes in accordance with Section 6(1)(f) GDPR. From this data, pseudonymised user profiles can be created and evaluated for the same purpose. Cookies may be used for this purpose. Cookies are small text files that are stored locally in the cache of the Internet browser of the page visitor. The cookies enable, among other things, the recognition of the Internet browser. The data collected using Matomo technology (including your pseudonymised IP address) is processed on our servers.

The information generated by the cookie in the pseudonymous user profile is not used to personally identify the visitor to this website and is not combined with personal data about the bearer of the pseudonym. If you do not agree with the storage and evaluation of this data from your visit, you can object to its subsequent storage and use at any time by mouse click. In this case, a so-called opt-out cookie is stored in your browser, which means that Matomo does not collect any session data. Please note that the complete deletion of your cookies means that the opt-out cookie will also be deleted and may have to be reactivated by you.
